Compulsory Purchase of Land
There is little doubt that large scale infrastructure projects can bring great benefits to communities and the economy but they can also present farmers with very important and often stressful decisions.
Brief
Compulsory purchase is a necessary part of any government scheme where tax payers money is at stake. Legislation is designed to provide fair compensation and where possible assist land owners to affectively mitigate their losses and continue normal farming operations. However, it is always advisable to seek the skills of an experienced negotiator who will, when required, work in tandem with the acquiring body and help manage all issues connected to your property.
Conclusion
These may include quantification of losses, due diligence, coordination with the principal over access and timing of works and ultimately concluding the claim and reinstatement of land where applicable. We were engaged for several clients for the recent Airdrie to Bathgate Rail Project and worked closely with them to ensure that disruption was kept to a minimum and that robust negotiation was undertaken when needed.
